1.2 Grupo Tours operates as an online tour operator platform that offers a wide range of tourism activities, including tours, packages, activities, and other personalized experiences. It is important to keep in mind that descriptions, photographs and other content related to tourist activities are provided for reference purposes. We have no direct control over such content.
2. Reach
2.1 Grupo Tours’s Terms and Conditions apply to all visitors and users (hereinafter “users”) and to all content on digital and physical platforms. By using the Grupo Tours platform, you are obliged to comply with the Terms and Conditions established by Grupo Tours. Therefore, we strongly recommend that you read these Terms and Conditions carefully before using it for the first time.
2.2 Grupo Tours’s Terms and Conditions apply to all our services, unless more specific regulations are established for a particular service. If there are additional regulations, we will explicitly mention them in the corresponding point. It is important to note that user conditions that conflict or differ from the Grupo Tours Terms and Conditions will only be valid if we have expressly accepted such conditions in writing.
2.3 The use of the Grupo Tours platform is intended exclusively for personal use and is not permitted to be used for commercial purposes under any circumstances. It is important to note that the resale of tours, packages or activities is strictly prohibited. Any activity that exceeds personal use in a private environment and/or has commercial purposes for you, associated persons and/or third parties, including the resale of tickets, is strictly prohibited.
3. Payments in Grupo Tours
3.1 The price indicated applies exclusively to the activity in question.
3.2 The accepted payment methods are those that are detailed on our platform.
3.3 It is considered that children over 5 years old must pay the rate established for children.
3.4 Children are defined as those who are between the ages of 5 and 10.
3.5 Children between 3 and 5 years old do not have to pay any fee.
3.6 All users over 10 years of age must pay the rate established for adults.
3.7 In order to verify the age of all users, they will be asked for their corresponding identification.
4. Reservation policy
4.1 All reservations are subject to the availability of places.
4.2 The amount payable when booking an activity corresponds to 50% of the total price indicated. Unless otherwise agreed, this amount must be paid immediately after making the reservation. It is important to keep in mind that the reservation must be made at least 7 days in advance of the scheduled date of the service.
4.3 To formalize the reservation, the following information is required to be sent:
4.3.1 Copy of the passport or identity document (DNI) of each passenger who will participate in the tour.
4.3.2 Send a copy of the corresponding voucher or proof of payment.
4.4 In the event that payment must be made in a foreign currency other than the national currency, Grupo Tours reserves the right to demand payment in the national currency and convert the corresponding amount into the foreign currency using the exchange rate in force at the time. to enter into the contract.
4.5 If you wish to request a refund of the booking price outside of our cancellation policy, we recommend that you contact us. We will evaluate your refund request at our discretion and make a decision.
4.6 You must provide accurate payment information and update it promptly in the event of any changes. The payment methods accepted for the activity are specified during the reservation process.
4.7 The reservation confirmation will only be issued through our official channels. The confirmation response we send will include a reservation ticket that will serve as guarantee of your reservation.
4.8 Hotel reservations, packages and promotions are subject to availability. Hotel rates may vary and are not valid for long weekends or holidays according to the calendar, such as Easter, National Holidays, Christmas, New Year, among others. In those cases, the hotel will establish the rate and the minimum number of nights for the package or the published rates according to the season or date.
4.9 The 10% exemption from the General Sales Tax (IGV) only applies to foreign passengers accredited with their passport and their Andean card, which must indicate that they have not stayed in the country for more than 60 or 90 days. If you do not meet these requirements, remember that the cost of tours, packages and activities do not include the 10% VAT.
4.10 In the case of reservations for overflights to the Nazca Lines:
4.10.1 Fares are subject to variations according to adjustments imposed by airlines.
4.10.2 The flight schedule may vary due to weather conditions, air traffic and/or reservation priority. Grupo Tours is not responsible for delays caused by these factors mentioned above.
4.11 For last minute reservations, payment of 100% of the agreed amount will be required to confirm your reservation.
4.12 Full payment for the service must be made by paying 100% of the agreed amount 48 hours before the date of the service.
4.13 Each reservation is independent and it is not allowed to transfer part or all of the payment made to third parties.
4.14 The price of booking the services does not include insurance. You are responsible for having adequate insurance coverage. We highly recommend purchasing travel insurance, especially if you are doing an outdoor or high-risk activity.
4.15 The published rates for tours, packages and activities are valid for most days of the year, except for long weekends and holidays according to the calendar, such as Easter, National Holidays, Christmas, New Year, among others. On these special dates, a 20% increase on regular rates will be applied.
5. Changes and cancellations
5.1 Cancellations by the agency:
5.1.1 Grupo Tours reserves the right to cancel services in situations where the life and integrity of our clients are endangered. This may occur due to natural disasters in the vicinity, political instability, demonstrations or other external events that make the operation of the planned itinerary unfeasible. In the event of service cancellation, our first option will be to reschedule the event for another convenient date. If this is not possible, a 100% refund of the amount paid will be made.
5.1.2 Grupo Tours reserves the right to exclude a client from an activity if they do not meet the established participation requirements, if their participation would present a danger to themselves or others, or if they would disrupt the proper development of the activity. In such cases, no refund will be made of the price paid for the reservation of the canceled activity.
5.2 Cancellations by the user:
5.2.1 In case of cancellations made more than 7 days in advance of the start of the activity, a full refund of the reservation price will be made.
5.2.2 For cancellations made less than 7days before the start of the activity, or in the event that the client does not show up, no refund will be made.
5.3 Changes by the agency:
5.3.1 Grupo Tours reserves the right to make minor changes to the activity program at any time if it considers this necessary due to unforeseen circumstances. These minor changes may include modifications to the starting/meeting point of the activity, as long as the new meeting point is accessible on foot or by public transport within a maximum of 15 minutes from the original meeting point. Changes to the departure/meeting point can be made up to 24 hours before the start of the reserved activity.
5.4 Changes by the user
5.4.1 In the event that a postponement of the date of the activity, changes in the number of participants or other type of variation is requested more than 36 hours in advance, a charge for administration costs equivalent to 50% of the amount will be applied. total reservation cost.
5.4.2 Postponements of the activity date, changes in the number of participants or other similar types of variations are not permitted less than 36 hours before the start of the tour.
5.5 We reserve the right to notify you of any changes or cancellations, particularly at short notice, using the contact information you have provided to us. This may include sending notifications via the registered phone number, as well as sending changes by email or WhatsApp to the address provided.
6. Data protection
6.1 All personal data collected will be processed by Grupo Tours as data controller, in accordance with applicable data protection laws and for the purposes described in our Privacy Policy.
6.2 Grupo Tours does not share any type of information or personal data with third parties.
6.3 We collect personal information, such as your name, email address and telephone number, in order to use it for various commercial and promotional purposes. From time to time, we will send you emails regarding special offers and other promotional information. If you do not wish to receive these offers and emails from us, we invite you to let us know by sending an email to reserva@grupotours.pe. We will respect your preference and stop sending you these types of communications.
7. Carrying out the activity
7.1 It is the user’s responsibility to arrive at the meeting point designated by Grupo Tours well in advance. If you are traveling from abroad, it is your responsibility to have the necessary travel documents (passport, visa, etc.), comply with health regulations and any other necessary requirements.
7.2 The user is obliged to comply with the schedule rules established by the guide or Grupo Tours. If you fail to do so, Grupo Tours or the guide has the authority to leave the site. The guide agrees to communicate with the user through the contact number provided, making a maximum of 5 calls. If no response is obtained within a maximum period of 10 minutes, the guide will leave the place, making it clear that the user will be responsible for covering their own transportation to the next stop established by the itinerary or the guide.
7.3 The waiting time at the departure point will not exceed the time established in the boarding schedules. It is the passenger’s responsibility to arrive at the departure point on time and respect the established schedules. In case of delay, the company will not accept claims for loss of the tour or any inconvenience derived from non-compliance with the schedules by the passenger. All tour participants are strongly recommended to arrive at the departure point well in advance to avoid any mishaps and ensure their participation in the activity.
7.4 No additional stops will be made to board passengers who arrive late at the meeting point. It is the responsibility of the passenger to arrive at the designated location on time and in accordance with the established schedules. Boardings along the way are clearly identified and the tour itinerary does not include extra stops to pick up late passengers.
7.5 All calculations of times and deadlines mentioned in the tour are based on the time zone of Peru (GMT-5). It is the participant’s responsibility to adjust their schedule and be punctual according to this time zone. Any discrepancies in schedules due to different time zones or changes in local time will not be the responsibility of Grupo Tours. Participants are recommended to adjust their devices and watches to the Peru time zone before starting the tour.
7.6 Seats on the tour are not numbered and will be allocated to passengers on a first-come, first-served basis. Upon boarding, the passenger will accept the seats available at that time, according to his or her arrival time. Grupo Tours does not guarantee the availability of specific seats and reserves the right to make changes to seat assignments for operational or safety reasons. Passengers must cooperate and follow the instructions of Grupo Tours staff regarding seat assignments. Passengers are recommended to arrive early enough to ensure a better place in the vehicle.
7.7 To ensure the safety and well-being of all participants, it is established that babies under 2 years of age and people over 70 years of age will not be allowed on the tour. These restrictions apply due to the nature of the activities and the possible associated risks. Grupo Tours reserves the right to request documentation verifying the age of the participant. In the event of non-compliance with this policy, Grupo Tours reserves the right to deny participation in the tour without the right to a refund.
7.8 Boarding while intoxicated or under the influence of narcotic substances is strictly prohibited. If this situation is detected, the company will contact the corresponding authorities to inform about the passenger’s status.
7.9 Smoking, consuming alcoholic beverages or narcotics is strictly prohibited inside the vehicle during the tour. This policy is intended to ensure the safety and comfort of all passengers, as well as comply with relevant laws and regulations. Any violation of this policy may result in immediate exclusion from the tour without the right to a refund
7.10 Respectful and courteous behavior towards assistance staff is required at all times during the tour. Disrespect, insults, harassment or any type of action that could be considered disrespectful or offensive towards Grupo Tours staff is strictly prohibited. This policy applies without exception and any violation of this policy may result in immediate exclusion from the tour without the right to a refund.
7.11 It is strictly prohibited to carry weapons of any kind, as well as sharp or cutting objects during the tour. Participants must ensure that they do not carry any items that may pose a risk to the safety of themselves, other participants or Grupo Tours staff. In case of non-compliance with this policy, necessary measures will be taken, including exclusion from the tour and notification to the competent authorities
7.12 Grupo Tours is not responsible for items lost or forgotten during the tour. Passengers are responsible for their personal belongings and are strongly recommended to take care of their valuables. Grupo Tours will not assume any responsibility for the loss, damage or theft of personal items during the development of the tour. Passengers are advised to keep their belongings in their custody and take the necessary precautions to avoid any loss or theft.
7.13 Pets are not allowed during the tour. Participants must refrain from bringing any type of pet, including dogs, cats or other animals, unless otherwise specified in a written agreement with Grupo Tours. This restriction is applied for reasons of safety, comfort and consideration for other participants. Any breach of this policy may result in exclusion from the tour without the right to a refund
7.14 During peak seasons (Easter, National Holidays, New Year, etc.), our clients are strongly requested to be patient in case of tour delays, as this is beyond our control.
8. Itinerary
8.1 Itineraries are carefully organized and provided to our clients on time; however, for operational reasons, it may be necessary to change the order of activities.
8.2 The company reserves the right to make changes to the order of excursions or trips without prior notice, due to weather conditions, natural disasters, river levels or other external reasons that may affect the development of the tour.
9. Minors
9.1 We do not sell tourist packages to minors (<18). If the purchase has been made by the parents, the guardian will be asked to sign the travel permit document, attaching a copy of the guardian’s ID and a copy of the ID of the minor who will travel. In addition, the father assumes all responsibility as established in law 27444 of the general administrative procedure and other regulations in force in this type of cases.
10. Incidents
10.1 We and our users understand that human error may occur. Therefore, we have established a clause of understanding and solidarity towards our collaborators and users. We understand that a passenger may need to cancel a trip at the last minute due to sensitive circumstances, such as health problems, accidents or loss of a family member. In such cases, the passenger must notify by email and attach the necessary documentation to proceed with the date change. Likewise, the passenger understands that, due to situations such as traffic, accidents or theft, there may be delays in the arrival of the mobility or the guide to a specific point.
10.2 In the event that a tourist causes any type of damage to the Grupo Tours vehicle or other personal property during the tour, he or she will be responsible for assuming the total cost of the repair or replacement of the damaged property.
10.3 Grupo Tours reserves the right to evaluate the damage and determine the cost corresponding to the repair or replacement of the affected property. The tourist must reimburse Grupo Tours for the total amount of said costs within a period established by the company.
10.4 In the event that no agreement is reached on the costs of repair or replacement, Grupo Tours reserves the right to take the necessary legal measures to obtain the corresponding compensation.
10.5 The tourist accepts and acknowledges that he is responsible for taking care of and preserving Grupo Tours’s property during the tour. Any damage caused by negligence, misuse or inappropriate conduct will be the exclusive responsibility of the tourist, who must assume the related costs.
10.6 Tourists are advised to be careful and respect Grupo Tours property during the tour, avoiding any action that may cause damage or harm. In the event of any incident or accident, the tourist must immediately notify Grupo Tours staff so that the necessary measures can be taken.
11. Adventure activities
11.1 Adventure tourism activities, such as ATVs, sandboarding, buggies, bicycles, horseback riding, boat rides, among others, carry risks due to their nature. However, by participating voluntarily, the participant recognizes and accepts the risks associated with the development of adventure tourism activity in its various modalities. These risks have been explained and detailed previously.
11.2 Participation in adventure sports is subject to certain age restrictions. The participation of children under 12 years of age and people over 65 years of age in adventure tourism activities is not permitted. These restrictions apply due to the inherent risks and demanding nature of adventure activities. The safety and well-being of our participants is our top priority, and they are required to meet established age criteria to ensure a safe and satisfying experience.
11.3 Pregnant people are strongly advised to avoid participation in extreme sports during the tour. Practicing adventure sports carries inherent risks that could be detrimental to the health of the mother and fetus. Therefore, we recommend pregnant people consult with their doctor before participating in any adventure tourism activity. The safety and well-being of mother and baby are of utmost importance, and it is advised to exercise caution and follow medical advice at all times.
11.4 We understand that each person has different abilities and fitness levels, and these restrictions have been put in place to ensure the safety and proper participation of those involved. We appreciate your understanding and cooperation in respecting these restrictions.
12. Prohibited activities
12.1 The content and information available on the Grupo Tours services, including messages, data, information, text, music, sounds, photos, graphics, videos, maps, icons, software, code or other materials, as well as the infrastructure used to provide such content and information are exclusive to Grupo Tours. Additionally, you agree not to take the following actions:
12.1.1 Use the services or content for commercial purposes other than those explicitly authorized in this agreement and in the related specifications provided by Grupo Tours.
12.1.2 Access, monitor, reproduce, distribute, transmit, broadcast, display, sell, license, copy or in any way exploit any content of the services, including user profiles and photos, using robots, spiders, crawlers or other automated means , or any manual process, except as permitted by this agreement or with our express written permission.
13. Nondiscrimination:
